PREAMBLE

We believe the cornerstones of the Free Music Movement must be: Freedom, Access, and Music. Version 1.0 of the FAM License codifies these values into a license that grants, rather than restricts artists' freedoms, increases access to fans, and puts the focus back onto making music.

This license requires two steps: (1) the music must be copyrighted, and (2) the copyright owner must license the materials under this license by designating the materials in the accompanying MANIFEST. These two steps will secure the right of the creators of the music and all others to copy, and redistribute all materials licensed under the terms of the FAM license either commercially or non-commercially.

There is no warranty associated with this license. Materials distributed under the terms of this license are distributed WITHOUT WARRANTY.

FAM LICENSE

TERMS AND CONDITIONS FOR COPYING, BROADCASTING, DISTRIBUTION, AND MODIFICATION

0. This license applies to all materials listed in the accompanying MANIFEST file, in which the copyright holder has included a notice that the works may be distributed under the terms of the FAM License.

1. The licensee may copyi, broadcast, or redistribute the recorded audio performances as received under the terms of this license, commercially or non-commercially, provided the materials are distributed with a physical or electronic copy of this license, or a prominent link to http://famlicense.org, where the full text of this license may be found, and provided all notices that refer to this license are kept intact.

2. The licensee may modify her or his copy of the recorded audio performance and redistribute it under the terms of this license, providing the following terms are all met:
a) All artistic credits (see MANIFEST) distributed with the original version of the recorded audio performance as licensed under the FAM License must be retained. In the event that the licensee has not received a copy with these artistic credits intact, the licensee may not redistribute the materials without first procuring these musical credits.

b) The licensee may only distribute a modified version of the recorded audio performance either in whole or in part, if said modified version is licensed under the terms of the FAM License. A modified version includes any work that includes the original recorded audio performance in modified or unmodified form.

c) The licensee may not change the titles of any works redistributed in modified or unmodified form without the express permission of the artist.
These terms apply to the modified work as a whole. If there are identifiable sections of the work that are not derived from the recorded audio performance and can reasonably be considered independent and separate works in themselves, then this License and its terms do not apply to those sections when the licensee distributes them as separate works.

3. The licensee may copy, modify, or redistribute the recorded audio performance only as expressly provided for under the terms of this license.

4. Each time the licensee redistributes the recorded audio performance in modified or unmodified form, the copyright owner directly grants the new licensee all rights and restrictions of the FAM License. No further rights or restrictions on the recipients' use of the recorded audio performance may be added.

5. The FAM Foundation may publish new or revised versions of this license from time to time. If the recorded audio performance is licensed under a particular version of this license, the recorded audio performance may be distributed under the terms of that version or any later version of the FAM License.

6. If the licensee wishes to distribute any of the materials distributed under the terms of the FAM License under different terms, this may be done only with the express permission of the copyright holder. The licensee must contact the copyright holder directly in order to procure permission for this redistribution.

7. The FAM License applies only to the recorded audio performance licensed under its terms. It does not apply to recorded audio performances that are synchronized with visual images.

8. The materials licensed under the terms of the FAM License are distributed without warranty to the extent permitted by applicable law.
